of B Signature collection hotels

 

PREAMBLE

These General Conditions aim to define the terms and conditions under which the hotels in the B SIGNATURE Hotels & Resorts collection allow their customers (hereinafter "the Client(s)") to benefit from all services, particularly reservations available on:

ARTICLE 1: GENERAL PROVISIONS

The Client is invited to carefully read these General Conditions, the prior acceptance of which is mandatory for the reservation of any service offered on the Site. It is recommended that any Client save and print these General Conditions using the standard features of their browser and computer. The Client must also consult the specific conditions of the selected rates that are specific to each hotel before validating their reservation.

For any other reservation method, the Client receives the general conditions of sale with the confirmation of their reservation. The confirmation of the reservation implies adherence to these Conditions and full and unreserved acceptance of their stipulations.

B SIGNATURE Hotels & Resorts, acting both on its own behalf and on behalf of its member companies, reserves the right to modify or complete at any time all or part of these General Conditions. In this case, the new version of the General Conditions will be available on the Sites with its effective date. Clients are advised to regularly consult the General Conditions to be aware of any possible modifications. In any event, the Client will only be bound by the version of the General Conditions in effect at the time the Client makes the reservation for their service.

B SIGNATURE Hotels & Resorts and its member companies are not responsible for any damages of any kind that may result from these changes and/or temporary unavailability or even the permanent closure of all or part of the Site or the services associated with it, such as the online reservation space, the private space, the unavailability of the reservation service of the B SIGNATURE Hotels & Resorts collection hotels.

The Sites contain the following information:

Prior to the reservation, the Client declares that this reservation is made for their personal needs. The Client, as a consumer, has specific rights that would be challenged if the Services reserved were not for personal purposes.

All information provided on the Site(s) is presented in French as well as in other foreign languages.

The Client declares having full legal capacity allowing them to commit under these General Conditions.

Any reservation made by a minor (between 16 and 18 years old) will only be taken into account by the B SIGNATURE Hotels & Resorts collection hotels after obtaining a liability release signed by the minor's legal representatives who made the reservation and any accompanying minors. The B SIGNATURE Hotels & Resorts collection hotels reserve the right to request any necessary documents to authenticate the signature of the release.

ARTICLE 2: PURPOSE

These General Conditions define the rights and obligations of the Client and the operating company of a hotel in the B SIGNATURE Hotels & Resorts collection for all types of reservations (including remote reservations) of services offered by the B SIGNATURE Hotels & Resorts collection hotels.

They govern all the steps necessary for the reservation and the follow-up of the reservation between the contracting parties.

The Client acknowledges having read and accepted these General Terms and Conditions of Sale and the specific terms of sale of the reserved rate.

ARTICLE 3: RESERVATION

The Client selects services from those offered by the B SIGNATURE Hotels & Resorts collection hotels according to their needs.

The Client acknowledges having taken note of the nature, price, destination, and reservation terms of the available services and having requested and obtained the necessary and/or additional information, particularly the specific terms of sale of the reserved rate, to make their reservation with full knowledge of the facts.

The Client can individually book a maximum of 7 rooms per reservation on the Sites. For any reservation of more than seven rooms, the Client can: be called by the sales team by sending a request by email to the dedicated contact for the organization of Events & Groups whose contact details are indicated in the "Events & Groups" tab on each hotel's Site, call this same dedicated contact, or send a quote request specifying the details of the services they wish to reserve.

The Client is solely responsible for their choice of services and their suitability for their needs so that the responsibility of B SIGNATURE Hotels & Resorts and its member companies cannot be sought in this regard.

The reservation is deemed accepted by the Client at the end of the reservation process.

Any reservation is nominative and cannot be transferred to a third party, whether free of charge or for a fee. Any reservation made for another person must be made in the name of the third-party holder of the stay.

ARTICLE 4: RESERVATION PROCESS

The reservation made by the Client is done directly online on the B SIGNATURE Hotels & Resorts Site, directly on each hotel's Site, or by phone at the contact details indicated on each hotel's Site in the "Contact Us" section.

The reservation request is confirmed upon receipt by the Client of the reservation confirmation sent by the concerned B SIGNATURE Hotels & Resorts collection hotel.

The Client undertakes, before any reservation, to complete the mandatory information requested to create the reservation file.

The Client certifies the truthfulness and accuracy of the information provided.

The reservation process includes the following steps:

  1. Step 1 - Search for a hotel among the various hotels in the B SIGNATURE Hotels & Resorts collection offered on the B SIGNATURE Site or directly on the concerned hotel's Site, choice of room, and the Specific Terms of Sale of the reserved rate.
  2. Step 2 - If applicable, select one or more additional services offered.
  3. Step 3 - Presentation of the reservation summary, its total price, additional fees and taxes, specific terms of sale of the reserved rate, including payment and cancellation terms, necessary modifications of the selected services (date, room, rate, additional service), and information concerning the tourist tax, service fees, fees related to card payments, and employee contributions.
  4. Step 4 - Communication of the Client's contact details.
  5. Step 5 - General Conditions of Sale and Personal Data Processing:
    • On the Site, the Client confirms by checking the box that they have read and accepted these General Conditions, the specific terms of sale of the reserved rate before finally validating their reservation, and the personal data processing charter; no reservation is possible without this agreement.
    • For any other reservation method, the Client receives the General Conditions of Sale with the reservation confirmation. The reservation confirmation implies adherence to these General Conditions of Sale and full and unreserved acceptance of their provisions.
  6. Step 6 - Communication of credit card numbers in case of a guarantee or prepayment request.
  7. Step 7 - Confirmation and Validation of the reservation and payment by the Client. Entering the banking information indicates the Client's acceptance and has the effect of contractually binding them to the selected B SIGNATURE Hotels & Resorts collection hotel.
  8. Step 8 - Receipt by the Client of the reservation confirmation email. This email summarizes the reservation date, the reserved services, the total prices including all taxes with details of applicable additional taxes and fees, the specific terms of sale of the reserved rate (including cancellation terms) accepted by the Client, the General Conditions of Sale, and the address of the reserved hotel.

In the absence of receiving the confirmation email within 24 hours of the reservation, it is the Client's responsibility to contact the selected B SIGNATURE Hotels & Resorts collection hotel to ensure the provided information and the consideration of the reservation.

ARTICLE 5: CANCELLATION OR MODIFICATION BY THE CLIENT

It is reminded to the Client, in accordance with Article L. 221-28 12° of the Consumer Code, that they do not have the right of withdrawal provided for in Article L. 221-18 of the Consumer Code.

The specific terms of sale of the reserved rate accepted by the Client specify the terms of cancellation and/or modification of the reservation. Reservations with prepayment for a non-refundable and non-cancellable rate cannot be modified and/or canceled.

The interruption of stay in the case of a reservation with prepayment for a non-refundable and non-cancellable rate does not result in any refund.

When the terms of sale of the reserved rate allow:

In case of a "no show," that is, a reservation not canceled but for which the Client did not show up at the reserved B SIGNATURE Hotels & Resorts collection hotel on the reserved day, and provided that the reservation was guaranteed by a credit card or prepaid, the reserved hotel will charge an indemnity of one reserved night or will not refund the prepaid amount. If several nights were reserved, the cancellation terms will apply according to the specific terms of sale of the reserved rate.

ARTICLE 6: CANCELLATION OR MODIFICATION BY THE HOTEL

In case of an exceptional event or inability to make the reserved room available to the Client or in case of force majeure, the reserved B SIGNATURE Hotels & Resorts collection hotel may offer the Client accommodation in a hotel of at least equivalent category or, if it is of a lower category, a room of a higher level than originally reserved for services of the same nature. Any additional costs related to this relocation for services of the same nature will be borne by the originally reserved B SIGNATURE Hotels & Resorts collection hotel. The Client may also cancel their reservation, which will result in an immediate refund.

ARTICLE 7: STAY AT A B SIGNATURE HOTELS & RESORTS COLLECTION HOTEL

Any person staying at the hotel must present valid identification at check-in. Otherwise, the B SIGNATURE Hotels & Resorts collection hotel may refuse to rent a room and/or cancel the reservation made without the possibility of a refund.

Foreign clients, including companions and adolescents over 15 years old, must fill out an "individual police form." Children under 15 can appear on the form of an accompanying adult. The information contained therein is governed by Articles R.814-1 to R.814-3 of the Code of Entry and Residence of Foreigners and the Right of Asylum.

The client may not introduce third parties into the room without the express authorization of the B SIGNATURE Hotels & Resorts collection hotel, which reserves the right to make all necessary verifications.

We welcome cats and dogs under 10 kilograms provided they are kept on a leash in all common areas of the establishment. The B SIGNATURE Hotels & Resorts collection hotel may refuse to accept any pet or other animal that may present a security risk to other occupants, with this risk assessment left to the hotel's discretion. For hygiene reasons, pets are not allowed in dining areas (these provisions do not apply to guide dogs or assistance dogs). To ensure everyone's peace, pets must not be left unattended. A surcharge per animal may be charged; please refer to each hotel's specific conditions on the Site for acceptance terms.

The Client agrees and commits to using the room and common areas reasonably. Any behavior contrary to security and/or hygiene principles, good morals, and/or public order may result in the B SIGNATURE Hotels & Resorts collection hotel asking the Client to leave the establishment without any refund.

Any damage caused by the client or occupants during their stay must be reported to the hotel reception and may be directly charged to the client for repair costs.

For safety reasons and to respect everyone, smoking is strictly prohibited within the Hotel. In accordance with the Public Health Code, smoking in the Hotel exposes the client to a fine for third-class offenses or legal action. Penalties of 250 euros may be applied if the Client does not comply with the posted no-smoking signs in their room.

Unless otherwise expressly provided, the Client must leave the room before 12:00 noon on the reservation's end date. Otherwise, an additional night will be charged.

ARTICLE 8: RESPONSIBILITIES

The photographs presented on the Site(s) are not contractual. Although all efforts are made to ensure that the photographs, graphic representations, and texts reproduced to illustrate the B SIGNATURE Hotels & Resorts collection hotels provide as accurate an overview as possible of the accommodation offered, variations may occur, especially due to furniture changes, renovations, or climatic phenomena. The Client cannot make any claims in this regard.

In accordance with laws and regulations governing intellectual property rights, the use and/or reproduction of any elements composing the B SIGNATURE Hotels & Resorts offers present on the Site(s) are strictly prohibited, as well as any reproduction of the decor and/or characteristic elements of the B SIGNATURE Hotels & Resorts collection hotels.

To respect the privacy and image rights of other clients of a B SIGNATURE Hotels & Resorts collection hotel, the Client is prohibited from photographing them within the hotel premises or its dependencies and/or publishing photographs taken under such conditions.

The GIE B SIGNATURE Hotels & Resorts and its member companies are not liable for any direct or indirect damages resulting from third parties, the Client, or the B SIGNATURE Hotels & Resorts collection hotels' partners. Hyperlinks may refer to other sites than the B SIGNATURE Hotels & Resorts hotels' Sites, which disclaim any responsibility for the content of these sites and the services offered. The GIE B SIGNATURE Hotels & Resorts and its member companies have implemented protection and security measures for their information system against malicious acts. However, connecting to the Site(s) and making a reservation implies that the Client acknowledges and accepts the characteristics and limitations of the Internet, the absence of protection of certain data against potential misappropriation or hacking, or risks of contamination by possible viruses circulating on the network. The GIE B SIGNATURE Hotels & Resorts and its member companies disclaim any liability in case of misuse or incident related to the use of the computer or any support allowing Internet access, maintenance or malfunction of the website, or any other technical connection, and sending information to an incorrect address. Any irregular, inoperative, incomplete, or fraudulent reservation or payment for a reason attributable to the Client will result in the cancellation of the order at the Client's expense, without prejudice to any civil or criminal action against them.

The B SIGNATURE Hotels & Resorts collection hotels reserve the right not to accept or to expel without refund clients whose attire is indecent and neglected, whose attire is intended to conceal the face (Law No. 2010-1192 of October 11, 2010), clients with noisy, inappropriate, or intoxicated behavior, clients with behavior contrary to hygiene, good morals, and public order. Proper attire is required in restaurants and public areas of each hotel. The Client must be courteous and respectful towards each hotel's staff. On pain of exclusion without refund, the Client must refrain from any verbal or physical violence, racist behavior or remarks, and any form of harassment.

ARTICLE 9: PRICES

The prices related to the reservation of services are communicated before and during the reservation. The communicated prices are per room for the number of person(s) and the selected date(s). Unless otherwise stated, additional services (breakfast, half-board, full board...) are not included in the price. Upon the Client's reservation confirmation, the total amount of the reserved services will be indicated.

The prices take into account the VAT applicable on the reservation date, and any change in the applicable VAT rate will automatically be reflected in the prices indicated on the billing date.

All additional fees applicable to the selected rate and their calculation method are explicitly communicated before and during the reservation. These include the tourist tax, employee contribution, service fees, and card payment fees when applicable according to the specific terms of sale.

The prices are confirmed to the Client, including all taxes (TTC), in the hotel's commercial currency (Euro). The communicated prices are only valid for a determined period. All reservations are payable in the hotel's local currency.

If a rate implies that payment is made at the B SIGNATURE Hotels & Resorts collection hotel in a currency other than the one confirmed on the reservation, exchange fees (conversion and bank fees) are the Client's responsibility. Note that if there is a conversion of the confirmed currency into another currency, it is given for information purposes only and is not contractual, considering the possible evolution of exchange rates between the reservation date and the stay date at the establishment. The tourist tax and any other specific taxes indicated for each rate are to be paid directly on-site at the hotel, except in the case of online prepayment where this amount may be included.

Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the prices indicated on the billing date. Indeed, rates may be increased by different taxes depending on the cities/countries. These taxes will be communicated to the Client at the time of reservation if they are known to the hotel at that time. If not, they will be displayed at the reception of the reserved B SIGNATURE Hotels & Resorts collection hotel. The Client undertakes to pay the different taxes without contesting them to the reserved hotel.

The B SIGNATURE Hotels & Resorts collection hotels guarantee that their best rates are offered on the Site(s). If, after booking a B SIGNATURE Hotels & Resorts collection hotel on the Site(s), the Client finds within 24 hours of their reservation an equivalent offer for the same dates at a lower rate for the same hotel, the same number of people, and the same type of room, the same services (breakfast, etc.) under the same conditions of sale (cancelable or non-refundable or not) on another website (excluding exclusions) excluding tourist tax but including file fees, the B SIGNATURE Hotels & Resorts collection hotels guarantee this rate with an additional product at the hotel's discretion.

ARTICLE 10: PAYMENT

The Client provides their payment data either (i) to prepay the reservation before the stay or (ii) as a guarantee for the reservation in case of "no show." When it is a credit card, the required information is: the credit card number without spaces between the digits, the validity date (it is specified that the credit card used must be valid at the time of the stay), and the visual cryptogram for prepayment.

The B SIGNATURE Hotels & Resorts collection hotels have chosen some of the most advanced current internet security technologies (Secure Socket Layer and Paytweak) to secure online prepayments by credit card through 3D Secure and/or via payment links. The Client's payment card is subject to security checks (balance control, card country control, IP address country control...) by the designated partner and may be refused for various reasons: stolen or blocked card, exceeded limit, input error, etc. In case of a problem, the Client must contact their bank on the one hand and the Establishment or any other entity on the other hand to confirm their Service reservation and payment method. The available and communicated online payment methods may include Visa and Mastercard, American Express, etc. This list is subject to change. The payment is debited at the B SIGNATURE Hotels & Resorts collection hotel during the stay, except in the case of special conditions or rates where the payment is debited during the reservation (prepayment on certain rates).

Payment by bank transfer may also be requested by the hotel for reservations over 2,500 euros or upon the Client's express request.

In case of payment at the hotel, each B SIGNATURE Hotels & Resorts collection hotel may accept different payment methods, but the Client must present the credit card used to guarantee the reservation or make the prepayment to ensure the Client's identity. The hotel may also request the Client to present an identity document for the prevention of credit card fraud.

If the Client has not prepaid their stay, the Establishment will ask the Client upon arrival for a security deposit or an authorization to debit the credit card to guarantee the stay corresponding to the total amount of the reserved nights plus a lump sum of 100 euros per person per day to guarantee extras.

This same guarantee will be required from invited third parties.

If the Client has prepaid their stay, the Establishment may ask the Client for a lump sum of 100 euros per person per day to guarantee extras.

In case of a no show, that is, a reservation not canceled but for which the client did not show up at the hotel on the reserved day, and provided the reservation was guaranteed by a credit card, the reserved B SIGNATURE Hotels & Resorts collection hotel will debit the amount of one reserved night as compensation due to the prejudice suffered due to the no show. If several nights were reserved, the cancellation terms attached to the reserved rate will apply.

At the time of prepayment, the amount debited during the reservation includes: the accommodation price, taxes related to the accommodation, the price of meals if breakfast is chosen, taxes related to meals, and all other selected additional services excluding the tourist tax and/or any other tax due to the Client's stay at the hotel.

ARTICLE 11: PERSONAL DATA

Your personal data requested as part of your reservation, namely your title, last name, first name, postal address, phone number with country code, email address, payment card references (number, card type, cardholder name, expiration date, and cryptogram if provided) as well as any data communicated or generated by your navigation, constitute confidential data.

They are only accessible to the GIE B SIGNATURE Hotels & Resorts and its member companies, as well as our subcontractor in charge of managing our "reservations" pages, for the purpose of processing your reservations and stays; provided you have accepted by checking the corresponding box to send you our newsletter or respond to your requests or communicate commercial offers. They are kept for the duration necessary for the business relationship established between the Client and the GIE B SIGNATURE Hotels & Resorts and its member companies.

Certain information requested in the forms is mandatory and marked with an asterisk. If you choose not to provide them, we will not be able to process your request. In accordance with the "Informatique et Libertés" law of January 6, 1978, as amended, and the General Data Protection Regulation (2016/679), you have, among other things, the right to access, rectify, erase, request the limitation of the processing of personal data concerning you. You also have the right to object to the processing of your data for legitimate reasons and the right to object to the processing of your data for commercial prospecting purposes, as well as the right to give us instructions regarding the fate of your data after your death. ARTICLE 12: PROOF AGREEMENT

Entering the required banking information and accepting these General Conditions and the reservation request constitutes acceptance of the hotel contract between the parties with the same value as a handwritten signature. The computerized registers stored in the information systems of the GIE B SIGNATURE Hotels & Resorts and/or its member companies will be kept under reasonable security conditions and considered as proof of communications, orders, and payments between the parties.

ARTICLE 13: FORCE MAJEURE

The GIE B SIGNATURE Hotels & Resorts and its member companies cannot be held liable to the Client in case of non-performance of its obligations resulting from a force majeure event. Similarly, the Client cannot be held liable to the GIE B SIGNATURE Hotels & Resorts and/or its member companies in case of non-performance of its obligations resulting from a force majeure event. Force majeure or fortuitous events are those usually recognized by the French courts and tribunals. The reserved hotel may offer the Client accommodation in a hotel of at least equivalent category or, if it is of a lower category, a room of a higher level than originally reserved for services of the same nature. Any additional costs related to this relocation for services of the same nature will be borne by the originally reserved hotel. The Client may also cancel their reservation, which will result in a credit note or an immediate refund.

ARTICLE 14: APPLICABLE LAW

These General Terms and Conditions of Sale are governed by French law.
This applies to both substantive and procedural rules.

The parties expressly agree that the formation, performance and interpretation of these General Terms and Conditions of sale, of any contract binding the Customer to a hotel in the B SIGNATURE Hotels & Resorts collection or of any other dispute with a hotel in the B SIGNATURE Hotels & Resorts collection shall be governed exclusively by French law, to the exclusion of any other legislation, regardless of any applicable conflict of laws rules.

ARTICLE 15: ENTIRETY

These General Terms and Conditions of Sale, the specific terms of the reserved rate selected by the Client, and the reservation confirmation express the entire obligations of the parties. No general or specific condition communicated by the Client can be incorporated into these General Conditions. The documents forming the contractual commitments between the parties are, in decreasing order of priority, the booking request (including the specific conditions of the reserved rate) validated by the Client and these General Conditions. In case of contradiction between the reservation confirmation and these General Conditions, the provisions of the reservation confirmation will apply exclusively for the obligation in question.

ARTICLE 16: DISPUTE RESOLUTION - EXCLUSIVE JURISDICTION CHOICE

In case of a dispute related to these General Conditions or any other disagreement with a B SIGNATURE Hotels & Resorts collection hotel, the parties will endeavor to find an amicable solution. For this, the Client must first contact the concerned hotel by email or postal mail to the contact details indicated on each Site. In the absence of an amicable agreement or in the absence of a response from the hotel within two (2) months, the Client can contact the consumer mediator whose contact details are:

The Client is also informed of the existence of a European Online Dispute Resolution ("ODR") platform to which they can resort. The Client can access it via the following link: https://ec.europa.eu/consumers/odr

In the event of failure of the non-contentious resolution procedures described above, the Parties agree to bring their disagreement or dispute exclusively before the courts located within the jurisdiction of the Paris Court of Appeal. They irrevocably waive any plea of lack of jurisdiction, whether relating to the material or territorial competence of the court seized, which they may raise to oppose the institution of proceedings before these courts.
